This website (jumpingpanda.mx) is operated by Jumping Panda. In these Terms, "we", "us" and "our" refer to Jumping Panda. By accessing or using the site, you accept these Terms of Service and all the policies referenced here (including our Privacy Notice). If you do not agree, please do not use the site.
Jumping Panda is a digital marketing agency: we build websites and online stores, manage social media, advertising and search rankings, and help businesses get started on marketplaces, among other services. We offer services, not physical products. This site is mainly informational and for contact.
Website vs. hiring our services (important). These Terms govern your use of this website. The hiring and delivery of our services is governed by the specific quote, proposal or contract we agree on with you for each project. In case of conflict over the scope, prices, timelines or deliverables of a service, that specific agreement prevails.
We may update or replace any part of these Terms by posting changes on this page. It is your responsibility to check it periodically; continued use of the site means you accept the changes.
Section 1 — Use of the site and eligibility
By using this site, you represent that you are of legal age in your place of residence, or that you are and you consent to letting minors in your care use the site.
You may not use the site for any illegal or unauthorized purpose, nor violate any law in your jurisdiction (including, among others, copyright laws). You must not transmit viruses, worms or any code of a destructive nature. Failure to comply with these Terms may result in the immediate suspension of your access.

You understand that the content you submit (not including payment data) may be transferred unencrypted over various networks and adapted to technical requirements. Payment data is processed in encrypted form by our payment providers.

Any reliance on this material is at your own risk. Prices and the scope of our services may change without notice. The prices of an already contracted project are set in its quote or contract. Section 5 — Our services
The scope, deliverables, timelines and price of each service are defined in the quote or proposal for your project.
We do not guarantee specific results. Our services (for example SEO, advertising, search rankings or social media management) depend on factors outside our control, such as the market, competition, user behavior and the policies and algorithms of third-party platforms like Google, Meta or TikTok, so we cannot guarantee search engine positions, a number of sales or leads, or any particular results. We commit to working professionally and following good practices.
We reserve the right to limit, refuse or discontinue the provision of services at our discretion.
Section 6 — Payments
Payments for our services are made through payment providers (Stripe, PayPal and Mercado Pago). They process your payment data directly, under their own policies.
You agree to provide truthful, complete and up-to-date payment information. Specific payment terms (deposits, monthly fees, balances and, where applicable, cancellation conditions) are defined in the quote or contract for each project. Because we offer services and not physical products, a returns policy does not apply. We reserve the right to refuse or cancel a request.
Section 7 — Optional third-party tools
We may give you access to third-party tools that we do not monitor or control. They are provided "as is" and "as available", without warranties. Your use of them is at your own risk, and you should review and accept the terms of the relevant providers.
Section 8 — Third-party links
The site may include links to third-party sites not affiliated with us. We are not responsible for their content, accuracy or any transactions you carry out with them. Review their policies before taking part in any transaction; complaints about third parties should be directed to them.
Section 9 — Comments and other user submissions

If you breach these Terms, we may terminate the agreement without notice; you will remain liable for amounts owed up to the date of termination, and we may deny you access to the site.

These Terms, together with the policies published on the site and the service quote or contract we agree on with you, constitute the entire agreement between you and us regarding use of the site and replace prior agreements. Any ambiguity will not be interpreted against the drafting party.
Section 18 — Governing law and jurisdiction
These Terms and any related agreement will be governed by and interpreted in accordance with the laws of the United Mexican States. For interpretation and enforcement, the parties submit to the jurisdiction of the competent courts of the State of Mexico, waiving any other venue that may apply to them.
